Act( 15 U.S.C. 1681c( d)) is amended–( 1) by striking “Divulged.– Any consumer reporting company” and inserting “Divulged.– “( 1) Title 11 information.– Any customer reporting firm”; and( 2) by adding at the end the following brand-new paragraph: “( 2) Key consider credit history information (IIX).– Any customer reporting agency that furnishes a customer report which contains any credit score or any other threat score or predictor on any consumer will consist of in the report a clear and conspicuous declaration that an essential element( as defined in section 609( f)( 2)( B)) that negatively impacted such rating or predictor was the variety of queries, if such a predictor was in reality a crucial aspect that negatively affected such rating.( e )Technical and Conforming Changes.– Section 625 (b )of the Fair Credit Reporting Act (15 U.S.C. 1681t( b)), as so designated by section 214 of this Act, is modified–( 1) by striking “or” at the end of paragraph( 2 ); and( 2) by striking paragraph( 3) and placing the following: [[ Page 117 STAT. 1978]] “( 3) with respect to the disclosures required to be made under subsection( c),( d),( e), or( g) of section 609, or subsection( f) of section 609 associating with the disclosure of credit ratings for credit granting purposes, except that this paragraph– “( A) shall not apply with respect to areas 1785. 16, and 1785. 20.2 of the California Civil Code( as in impact on the date of enactment of the Fair and Accurate Credit Deals Act of 2003 )and section 1785 – IIX.
